In this article, I argue, inter alia, that Kelsen’s mature view—as expressed in, and around the time of, second edition of Reine Rechtslehre—was a metaethical relativist, commitment to relativism was reason why Kelsen defended democracy as well tolerance in shape constitutionally guaranteed freedom thought. also consider possibility his post-1960 phase abandoned for moral fictionalism, but argue that, on whole, relativist interpretation late legal philosophy is be preferred fictionalist interpretation.
